1. Acceptance of these Terms
These Terms of Service (the "Terms") form a legally binding agreement between you and the operator of GTA Companion ("we", "us", or "the Provider") governing your use of the GTA Companion mobile application and any associated services (together, the "Service").
By installing, opening, or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and age
The Service is intended for general audiences. Grand Theft Auto Online itself is rated PEGI 18 / ESRB Mature, and we expect users to respect that rating. We do not knowingly target or collect personal data from children under 16. Anonymous browsing is open to anyone capable of using the underlying app store account.
3. About the Service
GTA Companion is a free, unofficial, fan-made companion app for Grand Theft Auto Online. It surfaces information about vehicles, weapons, businesses, daily events, and the latest in-game news. Information is sourced from publicly available material and from a curation pipeline operated by the Provider.
The Service is not affiliated with, endorsed by, sponsored by, or otherwise connected to Rockstar Games, Take-Two Interactive, or any of their affiliates. All Grand Theft Auto trademarks, characters, and copyrighted content are the property of their respective owners and are referenced under nominative fair use for the purpose of identifying in-game items.
4. Your account
You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us promptly via support@gtacompanion.com or Settings → Report a bug if you suspect unauthorised access.
You must provide accurate registration information and keep it up to date. We may refuse, suspend, or terminate accounts that contain misleading or fraudulent information.
5. Licence we grant to you
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the Service on devices you own or control, for non-commercial personal use.
You may not copy, modify, distribute, sell, lease, sublicense, reverse-engineer, decompile, or attempt to extract the source code of the Service except to the extent that applicable law (including the Dutch Software Directive implementation in Auteurswet Art 45j) expressly permits, and only after notifying us in writing.
6. Licence you grant to us
When you submit feedback, bug reports, reviews, or feature requests through the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free licence to use, reproduce, adapt, and incorporate that material into the Service. You warrant that any content you submit is your own and does not violate the rights of any third party.
7. Acceptable use
You agree NOT to:
a. use the Service for any unlawful purpose or in violation of any applicable Dutch, EU, or local law;
b. attempt to gain unauthorised access to any account, server, or network connected with the Service;
c. probe, scan, or test the vulnerability of any system, or breach any security or authentication measure;
d. interfere with the operation of the Service through denial-of-service attacks, automated scraping, or excessive request volume;
e. use the Service to harass, defame, or threaten any person, or to submit content that infringes intellectual-property or privacy rights;
f. resell, redistribute, or commercially exploit data obtained through the Service;
g. circumvent any rate-limiting, geofencing, or access-control mechanism we impose.
8. Service availability and changes
We provide the Service on a "best-effort" basis. We may modify, suspend, or discontinue any feature at any time, with reasonable notice via in-app message or email where the change is material. We are not liable for any unavailability of the Service that results from causes beyond our reasonable control (force majeure, third-party outages, etc.).
9. Content accuracy
We work hard to keep prices, stats, event windows, and news articles accurate, but the in-game state of GTA Online changes frequently and our pipeline can lag or misclassify. The Service is provided for informational purposes only — always verify a critical purchase or strategy decision in-game before acting.
10. Termination
By you: you may stop using the Service and delete your account at any time via Settings → Data & Privacy → Delete Account.
By us: if we reasonably believe you have materially breached these Terms, we may suspend or terminate your account. Where the breach is curable, we will give you reasonable notice and an opportunity to cure before termination. For breaches that present immediate harm (e.g. abusive scraping, security attacks), we may terminate immediately and notify you afterwards. You may appeal a suspension or termination by emailing legal@gtacompanion.com within 14 days, and we will respond within 30 days.
Sections 5, 6, 11, 12, 13, 14, 15, and 17 survive termination of these Terms.
11. Disclaimer of warranties
Except as required by mandatory consumer-protection law, the Service is provided "AS IS" and "AS AVAILABLE", without any warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
Nothing in this section limits your statutory rights as a consumer under Dutch and EU law, including your rights under the Dutch Civil Code (Burgerlijk Wetboek) Book 7 and the EU Consumer Rights Directive.
12. Limitation of liability
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or related to your use of the Service is limited to EUR 50, or, if higher, the amount you have paid us for the Service in the twelve months preceding the event giving rise to the liability (which, for a free Service, is zero).
We are not liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits, lost in-game currency or items, missed event windows, lost data, or business interruption — even if we have been advised of the possibility.
Carve-outs. Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) intentional misconduct or gross negligence; or (d) any other liability that cannot be excluded or limited under Dutch or EU consumer law.
13. Indemnification
You agree to indemnify and hold us harmless from any third-party claim arising out of: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) content you submit through the Service. This section does not apply where the claim arises from our own negligence or wilful misconduct, and is in any event subject to mandatory consumer-law protections.
14. Governing law and jurisdiction
These Terms are governed by the laws of the Netherlands, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.
Any dispute arising under these Terms will be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands. If you are a consumer resident in the EU, you may also bring proceedings before the courts of your country of residence, as required by Regulation (EU) 1215/2012 ("Brussels I bis").
15. Online dispute resolution
EU consumers may use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr. We are not, however, obliged to participate in ADR procedures and prefer to resolve disputes directly via legal@gtacompanion.com.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be flagged in-app on next launch and the "last updated" date above will move forward. We will give you at least 30 days' notice for changes that adversely affect you. Continued use of the Service after the effective date of a material change constitutes acceptance of the revised Terms.
17. Miscellaneous
Entire agreement. These Terms together with the Privacy Policy constitute the entire agreement between you and us regarding the Service.
Severability. If any provision is held unenforceable, the remaining provisions will continue in full force.
No waiver. Our failure to enforce any right does not constitute a waiver of that right.
Assignment. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, or sale of assets, with notice to you.
Notices. Notices to us go to legal@gtacompanion.com. Notices to you go to your registered email or, where you have no account, via in-app message on next launch.
